GENERAL CONDITIONS OF SALE – SERIAL DIVERS

NOTE: the english version is a courtesy version and only the french version is binding in the event of a dispute.

1. Scope

The General Terms and Conditions of Sale described below detail the rights and obligations of SAS SERIAL DIVERS and its customers (individuals and groups) in the context of the sale of services online from the site, excluding all other conditions and in particular those in force for in-store sales. Any service performed by SAS SERIAL DIVERS implies the purchaser’s unreserved acceptance of these general conditions of sale.

They do not apply for courses and exams accessible on registration file (GP-N4, Initiator, MF1, MF2, etc.), for which the applicable general conditions appear in the respective registration files.

A version of the general conditions of sale is available on the website of the SERIAL DIVERS diving center when the customer makes his reservation request for diving services.

2. Acceptance of the general conditions of sale

By contracting a service offered by the SERIAL DIVERS diving center, the customer accepts these general conditions of sale and declares to have read the contraindications to scuba diving and to be suitable for its practice. For any activity, the customer has the obligation to present a medical certificate for the practice of scuba diving dating from less than one year. This obligation does not apply to intro dive, discovery packs or snorkeling excursions. A minor customer must be in possession of parental authorization allowing him to perform the service he has ordered with the SERIAL DIVERS diving center.

3. Prices

All prices displayed are expressed in euros. The rate applicable and invoiced by the dive center to the customer is that in force on the day of the reservation request by the customer.

SERIAL DIVERS reserves the right to modify its prices at any time, but the products ordered are invoiced at the price in effect when the order is registered.

The season starts on October 1 of year N until September 30 of year N+1. SERIAL DIVERS reserves the right to modify its prices at any time.

If a crossed-out price is mentioned, it corresponds to the standard sale price of the service by the company, the uncrossed-out price corresponds to the price exceptionally charged by SERIAL DIVERS.

Special price offers are only valid within the double limit of the period of validity of the offer concerned and the places available.

4. Reservations

When purchasing a diving service, the customer will receive a reservation form which he must complete and return by email to contact@serialdivers.com in order to definitively validate his diving service.

Reservations will be confirmed upon receipt of the registration form and payment.

 

All dives are supervised by a French state-certified instructor.

The data recorded by the company SAS SERIAL DIVERS constitutes proof of the nature, content and date of the order. This is archived by the company SAS SERIAL DIVERS under the legal conditions and deadlines. The customer can access this archiving by contacting the Customer Relations department.

The SERIAL DIVERS diving center reserves the right to refuse any reservation from a customer with whom there is a dispute and more particularly a previous unpaid service. This also applies to anyone who does not present a state of health or fitness compatible with the practice of diving or snorkeling even if the latter presents a medical certificate.

5. Content of diving services

Leisure or Training Dives

The price of the leisure dive includes: transport to the site by boat and return to port, the supply of the tank inflated to 200 bars (3 000 psi) and the services of an instructor for the dive as well as all the necessary equipment except for the dive computer.

For divers wishing to do a night dive, they will be required to do a day dive if their last dive was over a year ago. In any case, only certified divers can dive at night.

Diving packages

The SERIAL DIVERS diving center offers decreasing price options for exploration dives, in the form of diving packages. These formulas are valid for a period of 12 months from the date of first use. Diving packages can be used by one or two divers maximum. Beyond the validity date, unused dive package dives are canceled. In the event of purchasing a new identical package, they may exceptionally be credited again by decision of SAS SERIAL DIVERS. If a diver does not complete his package within the allotted time, he will not be entitled to any reimbursement for unused dives.

Intro dive, Discover Scuba Diving and Snorkeling

The price of Intro Dive and Discover Scuba Diving includes: transport to the site by boat and return to port, the supply of the tank inflated to 200 bars (3 000 psi) and the services of a diving instructor as well as all the necessary equipment.

The price of the snorkeling excursions includes: transport to the site by boat and return to port, the services of the instructor for the snorkeling as well as all the necessary equipment.

For all other training  the price of the training includes: transport to the site by boat and return to port, supply of the tank inflated to 200 bars (3 000 psi) , the services of a diving instructor, all the equipment necessary for diving and the certification card. If available, we will provide an elearning course for the theory.

Diving equipment rental

The SERIAL DIVERS diving center makes available to customers, within the limits of available stocks, the following diving equipment: wetsuits, fins, masks, snorkels, BCD, regulators .

All equipment is included in the price of dives and training with the exception of the computer. The customer who has ALL his equipment exception tank and weights will be able to claim a discount on the price of his dive.

Inflating private blocks

The SERIAL DIVERS diving center offers air or Nitrox inflation services for private blocks.

The inflation service will be carried out after verification of the level and identity of the customer. This person makes a moral commitment to respect the french sports code and the regulations in force in the diving activity.

To be accepted for inflation, cylinders must, before connection to the device:

• be in good external condition
• Must have proof of visual inspection less than one year old
• Must have proof of hydrostatic Testing & Pressure Tank Testing every two years.

For NITROX inflation, proof of a Nitrox patent will be required during inflation.

No inflation higher than the service pressure of the cylinder will be carried out.

6. Activity Terms

Place of activity

The dives and practical training take place from the collectivity dock in Saint Barthélemy.

The SERIAL DIVERS diving center reserves the right to modify the location of the activity if necessary.

Activity times

The activity takes place (unless otherwise specified) all year round. The meeting place is the dive center. Depending on the seasons and the activity of the center, outing schedules are indicated on the website according to reservations.

The client can only register for services listed on the calendar for the requested time and day unless taking a private service.

Any delay by the client cannot result in a significant shift in activity. In the event that the customer does not show up on the day of the reserved diving service or at the scheduled time, no refund will be granted by SERIAL DIVERS.

Customer Obligations

The client must personally ensure that he is in possession of all the qualifications and supporting documents prerequisite for the activity he wishes to carry out and produce the originals to SAS SERIAL DIVERS before the start of these activities. Especially when they are required: patent, qualification, FFESSM licence, medical certificate.

Validation of a diving level or first aid training

The validation of a diving level is sanctioned by the success of practical and/or theoretical tests. The SERIAL DIVERS diving center reserves the right not to issue a diving or first aid level if the client has not achieved the minimum skills relating to the level claimed by the training. This scenario will not give rise to any reimbursement and they will be offered to complete their training in order to acquire the missing skills.

7. Cancellation, postponement, interruption of the diving service

By the customer

When booking, the customer returns a reservation form and pays for the service electronically.

If the customer wishes to cancel his order , he can do so by email at contact@serialdivers.com or by whatsapp at +590 690 516 786. The date and time of the message or email are authentic to determine the deadline cancellation.

• More than 72 hours before the date and time of the release, the full amount of the order will be refunded.
• Between 24 and 48 hours before the date and time of check-out, 50% of the total amount of the order will be refunded.
• Within 24 hours of the date and time of check-out, no refund will be made.

SAS SERIAL DIVERS reserves the right to accept the postponement of the service to other possible dates depending on the reservation schedule.

ATTENTION, unless the customer is unable to come to Saint Barth within one week of the date and time of the outing, there is no refund for all bookings made in the period from Christmas Day to New Year’s Day inclusive.

• GIFT CARD

Gift vouchers are not refundable.
It is possible to exchange a gift voucher for another service if the subject of the gift voucher is not suitable or to transfer it to a third party whose name must be communicated to us in order to make changes to the beneficiary.

• Postponement

By the customer

For the proper management of places, particularly on board its boats, in the event of a postponement request reported less than 24 hours before the start of the service, the service will be deemed to be due in full to SAS SERIAL DIVERS. In the event of cancellation reported more than 24 hours before the start of the service, the SERIAL DIVERS diving center may, if possible, offer another date to the customer so that he can carry out the reserved service. If the customer is unable to change the date, the order will be canceled.

Any activity started will not give rise to any refund, if the cancellation is due to the customer such as personal convenience, ear problem, stress or any other reason whatsoever.

Regarding training, a stay or an internship reserved for a defined period: SAS SERIAL DIVERS would not incur any liability if, for personal reasons, the client had to interrupt the training, stay or internship started, or if the client does not show up at the place or on the scheduled date. In particular, the amount of the service will remain acquired by SAS SERIAL DIVERS and all costs incurred will remain the responsibility of the customer. Consequently, the SERIAL DIVERS club advises its customers to take out cancellation insurance with a competent body.

In the case of a stay for a group made up of divers such as a “club ” outing, works council, etc. the price of the dives being indicated on the basis of a number of divers expected, no refund can be made if one or more dives were to be canceled for personal reasons or weather conditions that the client considers unfavourable.

 

By the dive center

A diving service may be canceled for meteorological or technical reasons.

In the event of cancellation for weather reasons, the SERIAL DIVERS diving center may offer to postpone the service to another more favorable date, subject to availability. If the customer is unable to postpone the services to another date, the sums already paid to the SERIAL DIVERS diving center will remain definitively acquired without any reimbursement being due.

The conditions are identical for a group made up of divers such as a “club ” outing, works council, etc.

In the event of cancellation for technical reasons, the SERIAL DIVERS diving center may propose the postponement of the service to another more favorable date, within the limit of available places. If the customer is unable to postpone the services to another date, SERIAL DIVERS undertakes to reimburse the amount of the services not provided.

In all these cases of unforeseeable circumstances or events, the additional costs resulting from the partial postponement, the total postponement or the extension of the stay remain the responsibility of the customer.

8. Security and personal effects

The SERIAL DIVERS diving center is in no way responsible for objects deposited or entrusted to the diving center or on the boats. The dive center cannot be responsible for theft or loss of personal property in the dive center or during the diving service.

9. Responsibilities

The customer is automatically covered in civil liability during the sessions organized by the dive center due to the insurance taken out by SAS SERIAL DIVERS. The customer is advised to take out additional insurance (bodily injury and material damage) to practice the activity of scuba diving as well as cancellation insurance with an authorized organization.

10. Competent court

The applicable law is French law. In the event of a difficulty relating to the interpretation and/or application of these general conditions of sale, the parties will try as far as possible to resolve their dispute amicably. In the event of failure of these attempts, any disputes to which these may give rise must be brought, even in the event of multiple defendants or a warranty call, before the competent courts falling within the jurisdiction of the Commercial Court of Basse Terre.
